Terms of Service

Who you are contracting with. Mockbird (模考鸟) is a brand operated by HORHORCHI CHINESE FLAVOUR PTE. LTD., a company incorporated in Singapore with UEN 202304437W (“we”, “us”, “the Company”). These terms form a contract between you and that company. All payments are made to, and all obligations under these terms are owed by, that company.
你在和谁签约。「模考鸟 / Mockbird」是 HORHORCHI CHINESE FLAVOUR PTE. LTD.（新加坡注册公司，商业注册号 202304437W，下称「本公司」）运营的品牌。 本条款构成你与该公司之间的合同；所有款项支付予该公司，本条款下的义务亦由该公司承担。

Governing language. These terms are published in English and Chinese. The Both versions are intended to convey the same meaning. If there is any inconsistency, the English version shall prevail, except to the extent that applying it would exclude a right that cannot lawfully be excluded.
本条款提供英文和中文版本，两种版本旨在表达相同含义。如有不一致，以英文版为准，但以该适用不会排除任何依法不得排除的权利为限。

Licence and permitted use

A purchase grants a personal, non-transferable, time-limited licence to access practice content online. It does not grant any right to download, copy, redistribute, resell or share account credentials. All questions are original works owned by HORHORCHI CHINESE FLAVOUR PTE. LTD..
购买获得的是本人、不可转让、有期限的在线练习访问许可，不包含下载、复制、再分发、转售或出借账号的权利。 站内题目均为原创，著作权归 HORHORCHI CHINESE FLAVOUR PTE. LTD. 所有。

Content protection

We do not provide downloads. Access controls, rate limits, per-account watermarking and leak-tracing are applied. We do not claim that screen capture is technically impossible; we do trace and act on redistribution.

Assignment / business transfer

We may assign these terms, and transfer related user data, to an affiliate or to an acquirer in connection with a merger, acquisition, reorganisation or transfer of assets. You may not assign these terms.

No affiliation

Mockbird, operated by HORHORCHI CHINESE FLAVOUR PTE. LTD., is independently developed and has no affiliation with, authorisation from, or endorsement by IBF, MAS or any examination body. All questions are original practice questions and are not actual examination questions.

Your account

An account is for one person. Sharing credentials, or letting anyone else practise on your account, is a breach of these terms — the mastery analysis is built on the assumption that one person answered, so sharing also makes your own report meaningless. You are responsible for keeping your sign-in details private.
账号仅限本人使用。共享账号或让他人用你的账号做题属于违约——掌握度分析建立在 「答题的是同一个人」这一前提上，共享同时也让你自己的报告失去意义。请自行保管登录信息。

Study aid only — no guarantee, not advice

Mockbird is a study aid. We do not guarantee that you will pass, that any topic will appear in your examination, or that our questions resemble the questions you will be given. Nothing here is financial, investment, legal or professional advice, and it must not be relied on in advising clients or making investment decisions. Where our content differs from the official study guide or a regulator's current position, the official source governs.

We use reasonable care in preparing the content, but it may contain errors, omissions or outdated information. It is supplementary material and does not replace the current official syllabus, study guide or examination rules. Mastery scores, pacing analysis and other analytics are estimates, not predictions of examination performance.

Our coaching and explanation features are software- and AI-driven practice and feedback tools. They are not a human tutor, and no one-to-one human tutoring is included unless we say so explicitly in writing.

Acceptable use and suspension

We may suspend or terminate access, without refund, where we find credential sharing, bulk extraction or scraping of questions, redistribution of content, or attempts to circumvent access controls. For anything else — a genuine dispute, a mistake, a disagreement — we will contact you first.
若发现共享账号、批量抓取题目、再分发内容或绕过访问控制，我们可暂停或终止访问且不予退款。其他情形（争议、误操作、分歧）我们会先与你联系。

Payment and activation

Collection arrangement. HORHORCHI CHINESE FLAVOUR PTE. LTD. (UEN 202304437W) is the seller and contracting party. The PayNow QR code shown at checkout is linked to an account held by an individual whom the Company has authorised solely to collect payment on its behalf as its disclosed agent. Payment for your Mockbird order to that payee constitutes payment to the Company; the Company remains responsible for activation, receipts, refunds, personal data and the Service.

代收安排。本服务的卖方及合同主体为 HORHORCHI CHINESE FLAVOUR PTE. LTD.（UEN 202304437W）。结账时显示的 PayNow 二维码绑定于个人名下账户，公司仅授权其以代收代理人身份收取本订单款项。就 Mockbird 订单向该收款人付款， 视为已向公司履行相应付款义务；开通、收据、退款、个人资料处理和服务责任仍由公司承担。

We currently accept PayNow only. There is no subscription and no automatic renewal: you pay for a fixed term (1 or 2 months) and it simply ends. Activation is manual — we enable your plan after the transfer clears, normally within a few hours. Put the email you signed in with in the transfer reference so we can match the payment to your account.
目前仅支持 PayNow。没有订阅、不会自动续费——按固定期限（1 或 2 个月）付款， 到期即止。开通为人工确认，通常在收到转账后数小时内完成；请在转账备注里填写你登录用的邮箱， 以便我们对上账号。

Refunds

Fixed-term access with no auto-renewal, so there is nothing to cancel. As a goodwill cancellation right, you may request a full refund by emailing [email protected] within 7 calendar days after Activation, provided that you have submitted answers to no more than 30 paid questions. “Activation” means the time shown in our activation confirmation. Requests received by 23:59 Singapore time on the seventh day qualify. Approved refunds will normally be returned to the original payer, via the original payment route, within 7 business days.

Nothing in this policy excludes or limits any right or remedy that cannot lawfully be excluded, including any remedy for an unfair practice, misrepresentation or material breach. The 7-day and 30-question limits do not apply to such rights. The appropriate remedy may include re-performance, extension of access, price reduction, refund or damages, depending on the applicable law and circumstances.

Scope. This goodwill right applies to the 1-month and 2-month plans and to the coaching add-on. One-off purchases (question packs and single mock papers) are consumed on use and are refundable only where a right applies under the paragraph above.Duplicate or incorrect payments, and any payment we cannot activate, are refunded in full on request regardless of the limits above.

Suspension. Where we suspend an account for suspected abuse, we will do so only on reasonable evidence, after appropriate enquiry, and proportionately. We will tell you why and give you a chance to respond before any refund is withheld.

固定期限、不自动续费，因此没有「取消订阅」这一步。作为本公司额外提供的善意取消权， 用户可在开通后 7 个日历日内发送邮件至 [email protected] 申请全额退款， 但前提是已提交作答的付费题目不超过 30 道。 「开通」指开通确认中显示的时间；公司在第 7 日新加坡时间 23:59 前收到的申请均视为在期限内。 获批退款通常会在 7 个工作日内按原支付路径退还给原付款人。

本政策不排除或限制任何依法不得排除的权利或救济，包括因不公平做法、虚假陈述或重大违约 产生的救济。上述 7 日期限和 30 题限制不适用于该等权利。 视适用法律和具体情况，救济可能包括重新履行、延长使用期、减价、退款或损害赔偿。

适用范围：本善意取消权适用于 1 个月、2 个月套餐及定制私教团加购。 一次性购买（题包、单套全真卷）属用即消耗，仅在上一段所述权利适用时可退。重复付款、错付金额，以及我们无法为其开通的任何款项，不受上述限制，经申请全额退还。

关于停权：如因涉嫌滥用而暂停账号，我们仅在有合理证据、经适当调查并遵循比例原则时才会这样做， 并会告知理由、给你申辩机会，之后才决定是否不予退款。

Privacy Policy (PDPA)

This notice is given under the Personal Data Protection Act 2012 (Singapore). 本声明依新加坡《个人资料保护法》作出。

What we collect and why

We collect only what the service needs, and for these stated purposes:

• Email address — to identify your account, attribute your attempts, watermark pages against redistribution, and match your payment to your account.
• Password — stored only as a salted cryptographic hash. We cannot read your password and never transmit it anywhere.
• Practice records (questions attempted, correct/incorrect, time taken) — to produce your mastery estimates, progress curve and pacing analysis. This is the core of the product; without it the personalisation cannot function.
• Technical data (IP address, browser type, access times) — for security, rate-limiting and abuse detection only.
• Account and entitlement records — plan, term start and end, weekly and lifetime usage counters, credit balance, unlocked mock papers.
• Payment records — amount, the payment reference you provide, the product and term purchased, payment status, and activation or refund timestamps. We record that a payment was claimed and later confirmed; we never see or store your banking credentials.
• Referral data — your share code, and the email address of anyone you refer, together with reward status.
• Support correspondence — emails you send us, including any receipt screenshots you choose to attach.
• Audit logs — a record of administrative actions taken on your account (for example activation or suspension), who took them and why.

We do not collect NRIC, date of birth, address, employer or payment card details. PayNow transfers settle bank-to-bank; we never see or store your banking credentials.

我们只收集服务必需的数据：邮箱（识别账号、归属作答记录、页面水印、对账）、密码（仅存加盐散列，我们无法读取明文）、练习记录（做了哪些题、对错、用时——这是个性化分析的基础，没有它产品的核心功能无法成立）、技术数据（IP、浏览器、访问时间，仅用于安全与反滥用）、账户与权益记录（档位、期限起止、周用量与终身用量计数、积分余额、已解锁全真卷）、付款记录（金额、你填写的转账参考、所购产品与期限、付款状态、开通与退款时间； 我们只记录「有人声称付款、后经确认」这件事，从不接触或存储你的银行凭证）、邀请数据（你的分享码、你邀请的人的邮箱及奖励状态）、客服往来（你发给我们的邮件，含你自愿附上的转账截图）、审计日志（我们对你账号做过的管理操作、由谁执行、原因）。
我们不收集 NRIC、出生日期、住址、雇主或银行卡信息。

Consent and withdrawal

By creating an account and using the service you consent to the above. You may withdraw consent at any time by asking us to close your account. Withdrawal takes effect prospectively; note that we cannot continue to provide the service without the data listed above, so withdrawal ends access.
注册并使用即表示你同意上述处理。你可随时要求关闭账号以撤回同意；撤回自提出后生效， 但由于上述数据是服务运行的前提，撤回同意即意味着停止使用。

Retention and deletion

Practice records are kept while your account is open, so your progress history stays meaningful. Technical logs are kept for 90 days. On account closure we delete or irreversibly anonymise your personal data within 30 days, except where we must retain records to meet legal, tax or accounting obligations.
练习记录在账号存续期间保留（否则成长曲线失去意义）；技术日志保留 90 天。 账号关闭后 30 天内删除或不可逆匿名化，法律、税务或会计要求必须留存的除外。

Access, correction and complaints

You may request a copy of the personal data we hold about you, ask us to correct it, or complain about how we have handled it. Write to our Data Protection Officer at the address below; we aim to respond within 30 days. If you are not satisfied you may refer the matter to the Personal Data Protection Commission (PDPC).
你有权查询、更正你的个人资料，或就我们的处理方式投诉。请联系下方数据保护官（DPO）， 我们力争 30 天内答复；若不满意，可向个人资料保护委员会（PDPC）反映。

Third parties and transfers

We do not sell personal data. We use service providers for hosting and for generating explanation translations; they process data on our instructions only. Where data is processed outside Singapore, we take steps to ensure a comparable standard of protection as required by the PDPA.
我们不出售个人数据。我们使用托管与译文生成等服务商，它们仅按我们的指示处理数据； 如涉及境外处理，我们将按 PDPA 要求确保可比的保护水平。

Limitation of liability

To the maximum extent permitted by law, and subject to the next sentence, our aggregate liability arising out of or in connection with the Service, whether in contract, tort (including negligence), misrepresentation or otherwise, shall not exceed the greater of (a) the fees paid for the affected Service during the 12 months immediately preceding the event giving rise to the claim and (b) S$500. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, wilful misconduct, or any liability that cannot lawfully be excluded or limited. This clause does not affect any non-excludable rights under the CPFTA, PDPA or other applicable law.

在法律允许的最大范围内，并以下一句为前提，公司因本服务产生或与本服务有关的累计总责任， 无论基于合同、侵权（包括过失）、虚假陈述或其他依据，均不超过以下两者中的较高者： （a）导致索赔的事件发生前 12 个月内，用户就受影响服务实际支付的费用； 及（b）S$500。本条不排除或限制因过失造成死亡或人身伤害、 欺诈或欺诈性虚假陈述、故意不当行为，或任何依法不得排除或限制的责任。 本条不影响用户依据 CPFTA、PDPA 或其他适用法律享有的任何不可排除权利。

Changes

We may update these terms and this privacy notice. The date at the foot of this page shows the current version. For changes that materially affect what you have already paid for, we will notify you by email before they take effect.

Governing law

These terms are governed by the laws of Singapore, and the courts of Singapore have exclusive jurisdiction. For small consumer disputes, the Small Claims Tribunals may be the quicker route for both of us.
本条款适用新加坡法律，由新加坡法院专属管辖。 对于小额消费争议，小额索偿法庭对双方而言通常是更快的途径。
